I had a non-payer and after notifying them and waiting my required 3 days (I mention this in every one of my ad's) then I opened the dispute. Ebay sends the buyer a notice that a dispute has been opened and I think you have to wait 5 days after. In my case after about 4 days my buyer paid for it so after ebay notified me, I shipped. I doublechecked to make sure that the buyer was not in one of the affected areas of the "superstorm".
