    Curb shopping ethics

    I had my other thread deleted for other reasons so it wouldn't affect my case. All I will say is I was arrested for curb shopping and picking a unit up. Now I did some digging. In the california v greenwood supreme court case it has been ruled anything on the curb is free game/public domain for anyone ranging from law enforcement officials to common criminals. If its on the curb its free to take they ruled for whatever purpose you deem fit including law officials using evidence gained without a search warrant to arrest you. Ie, you throw you bag of dope in the trash, you can be arrested for it and prosecuted without a search warrant.



    This overturned the previous 1974 privacy act.. Quite interesting and now is my bible for life. I will carry this law in my truck wherever I go. And on a interesting side note, only place I found that is illegal to curb shopping is NYC. But it is only a city ordinance. Still legal statewide and federal.

    Some food for thought and I hope this helps you as much as it did with me. And on that note, Im putting full camera surveillance/audio in my truck and taking pictures of anything I touch on the curb now on to protect myself. Let me know if this helps anyone...

    You have had a few threads deleted...You have the nerve to use the word ethics???? You have admitted to stealing, dmv violations and used foul and vulgar language in your descriptions of law enforcement because you were areested because you were greedy. Ethics??? Give me a break!!!!

    I've been following these posts for some time now and their quite the interesting read. The way I see it, Ozzy uses the gray area of the law to his advantage. There's not one person on this board that can't say they haven't at some point in their life(wither they admit it here or not) used this area to their advantage. I'm not defending him, but yelling at someone for using and working in this area is childish.

    Theft, removing a vin from one vehicle and putting it on another are both illegal. Use of foul language may not be a crime but it is against the rules here. No "grey" area that I can see.

    He deleted his last post about his arrest because I picked it apart and he knew that if anyone involved in that case saw it, it would have sunk him.

    Like I stated above he should be the last person to try to explain ethics to anyone here.

    This may get me in hot water but there is not one person here that has ever said theft is ok, and all have said how muh thieves are hated and give scrappers a bad name. Yet the op is still here. Its not only members who come here but also lurkers and possible customers for the buyers here. Do you think anyone would want to be associated with a buyer who has dealings with a thief, whether thay realize it or not?

    While I agree both are very illegal(country dependant), I don't see either/or in any of his posts. My post was about this last thing with the blower(and what this one started out as) as I saw that entire thread as working in the gray area of the law. Stuff that like that flys in parts of FL and here in NY. Only difference is up here(Onadaga County) they consider it the corporate edge. Business' and indivuduals work in this area all the time. Anything to get that overage over someone else or other business. Misnamed thread? Yeah, but that's about it.

    I hate a thief, and anyone that disrespectful to law enforcement. But expects to have one available when they need one. Why is this guy not banned? I thought condoning theft was an automatic..........

    Because it's not theft. Ozzy's already proven it isn't. People need to calm down and research before shooting their mouths off.

    You don't speak for me. Right is right and wrong is wrong. There is no gray area when comes to theft. Don't assume everyone is like you.

    And don't assume everyone shares your back and white views of the law. If there was no grey area, big box stores like Wal-Mart would no longer be in business.

    I'll stay out of the cesspool, but I can remember something other than a leaf blower, and swapping VIN plates is definitely illegal.

    I call BS on curb thing. So if I'm mowing my lawn and the mower runs out of gas at the curb and I go to get more from the shed in the back my mower is fair game for someone with no ethics? Better not let me catch you loading it up! I don't support violence but I would consider me and the thief taking my mower to be in the "gray area" of assault laws while I beat him with a bat or pipe!

    Even on garbage day, one should ask about taking something. Definitely if it's not garbage day.

    I feel he may be right but still do not know. Oz do you have a court date? Did you get a ticket? If so are you going to pay the fine? What are you suing for being falsely arrested? Truck impounded? What... Post your answers quick before thread goes away...

    When I first started out, I knew all about what ozzy is talking about in regards to if its on the curb I was protected by the same laws that protect the police when searching for evidence. However, I don't know how many weed wackers, kids bicycles, scooters, etc, that I left sitting where they were because things just didn't look right. kids are always leaving their stuff where it don't belong, maybe the weedwacker just ran out of fuel. If I could find someone I would ask if it was trash and if I could have it. If it was in the middle of the night when I usually did my picking I considered most things fair game if it was on the street side of the curb, if it was on the house side of the curb and didn't look right it stayed, kids bicycle 5 ft away from garbage cans stayed where it was at, kids bicycle with flat tires laid against the trash pile went in the truck. I could have made a lot more money if my morals were lowered a bit but I like my freedom that I have fought for.
